Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Shubham Dubey, an individual developer ("Wallscape," "we," "us"), the operator of the Wallscape mobile application and its backend services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service Is

Wallscape is a free mobile app for discovering, browsing, saving, and downloading wallpaper images to your device. Wallpaper images are third-party content sourced from the Wallhaven catalog (wallhaven.cc) and are displayed in the app directly from Wallhaven's servers; Wallscape hosts only metadata about the images (titles, dimensions, source links), not the images themselves. The catalog is curated to safe-for-work content.

The Service currently includes:

• Browsing and searching a curated catalog of wallpapers organized by topic.
• Saving wallpapers to your account and organizing them into boards.
• Downloading wallpapers to your device's photo library.
• A personal profile (name, age, gender, favorite topics) used to personalize the experience.

The Service does not currently include paid plans, subscriptions, in-app purchases, advertising, or AI-generated content. If we introduce paid features in the future, we will update these Terms first.

2. Eligibility

You must be at least 13 years old to use the Service. The app asks for your age during onboarding and does not accept ages under 13. If you are under the age at which you can consent to these Terms in your jurisdiction, you may use the Service only with the consent of a parent or legal guardian.

3. Accounts

You can create an account in one of two ways:

• Email and password. You choose a password of at least 8 characters. Note that the Service does not currently offer a self-service password reset; if you lose your password, contact us at [email protected].
• Email verification code (passwordless). We email you a one-time 6-digit code that expires after 10 minutes. Accounts created this way have no password.

You are responsible for: (a) providing an email address you control, (b) keeping access to that email address and any password secure, and (c) all activity that occurs under your account. Signed-in sessions remain valid for up to 30 days on a device; signing out removes the session from that device.

Notify us at [email protected] if you believe your account has been accessed without authorization.

4. Acceptable Use

You agree not to:

• Access the Service by any means other than the Wallscape app or interfaces we provide, or use scrapers, bots, or bulk-download tools against our API.
• Circumvent or attempt to circumvent rate limits, verification-code limits, or other technical protections. (The Service enforces request rate limits and locks verification codes after repeated failed attempts; exceeding limits results in temporarily refused requests.)
• Probe, disrupt, overload, or interfere with the Service or its infrastructure, or attempt to access other users' accounts or data.
• Use the Service to violate any law or third-party right, including the intellectual-property rights of wallpaper creators.
• Misrepresent your age or identity when creating an account or completing onboarding.

Board names and profile information you enter must not be unlawful, hateful, or infringing. Boards and saved wallpapers are private to your account and are not visible to other users.

5. Wallpaper Content and Intellectual Property

Wallpaper images available through the Service are created and owned by third parties and made available via the Wallhaven catalog. Wallscape does not own the wallpaper images and grants you no rights in them. Any rights you have to use a downloaded image come from the image's rights holder and applicable law, not from us. The Service is intended for personal, non-commercial use of wallpapers (e.g., setting them as your device background). You are responsible for any other use you make of downloaded images.

If you are a rights holder and believe content available through the Service infringes your rights, contact us at [email protected] and we will review and, where appropriate, remove the content from our catalog.

The Wallscape app, its design, branding, and software are owned by Shubham Dubey or their licensors. You may not copy, modify, distribute, or reverse-engineer the Service except where the law permits it notwithstanding this restriction.

6. Your Content

The content you contribute to the Service is limited to your profile details (name, age, gender, favorite topics) and the names of boards you create. You retain any rights you have in that content. You grant us a non-exclusive, worldwide, royalty-free license to store, process, and display that content solely to operate and improve the Service for you. This license ends when your content is deleted from the Service.

7. Third-Party Services

The Service depends on third parties whose availability and terms affect your use:

• Wallhaven (wallhaven.cc) — wallpaper images load directly from Wallhaven's servers onto your device. Your use of those images is also subject to Wallhaven's own terms and policies, and image availability depends on Wallhaven.
• Resend — delivers verification-code emails on our behalf.
• Hosting providers — our database runs on Supabase and our API runs on Render.

We are not responsible for third-party services, and content may become unavailable if a third-party source removes it.

8. Availability and Changes to the Service

The Service is provided free of charge and on an as-available basis. We may change, suspend, or discontinue any part of the Service (including the wallpaper catalog, which is periodically re-synced and may add or remove images) at any time without liability to you.

9. Suspension and Termination

You may stop using the Service at any time. To delete your account, use "Delete account" in Settings or contact us at [email protected]; deletion is currently handled as a support request rather than automatically. Deleting your account permanently removes your profile, boards, and saved wallpapers.

We may suspend or terminate your access (including by refusing requests, invalidating sessions, or deleting your account) if you violate these Terms, if required by law, or if we discontinue the Service. Where reasonable, we will notify you at your account email.

10. Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. Although the catalog is filtered to safe-for-work content at sync time, wallpaper images are third-party content and we do not guarantee that every image is accurate, appropriate, or lawfully uploaded to its source.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. TO THE SAME EXTENT, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED USD $50 (OR THE EQUIVALENT IN YOUR LOCAL CURRENCY), REFLECTING THAT THE SERVICE IS PROVIDED FREE OF CHARGE. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

12. Indemnification

You will indemnify and hold harmless Shubham Dubey from claims, damages, and reasonable expenses (including attorneys' fees) arising from your violation of these Terms or your misuse of the Service or of downloaded content, to the extent permitted by applicable law.

13. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide notice (for example, by email to your account address or an in-app notice) before the changes take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to conflict-of-laws rules. Disputes will be resolved exclusively in the courts at Faridabad, India, unless applicable consumer-protection law gives you the right to bring claims in your local courts.
